Annual Meeting at PA NENA Conference

Thursday, September 10, 2009    15:00 hrs

State College, PA

 

 

The meeting was called to order at 15:12.  The pledge of allegiance followed.

 

Old Business

 

Mike Weaver presented the proposed changes to the chapter’s constitution and bylaws (see attached).  A motion was made by Steve Shaver, a second by Scott Krater to approve the attached constitution and bylaws.  Motion was carried by the body.

 

Committee Reports

 

Conference:

Mike McGrady gave an update on the conference.  There are 234 attendees.  Approximately 25 walk-ins and 33 registered vendors.  He believes the conference going well, as he has received a lot of compliments so far.

 

Legislative:

Mike McGrady updated the body on two bills, the Pre-paid legislation and the MTLS/PBX.  Regarding pre-paid, we are not collecting the right amount of money.  The committee estimates that we should be getting $18 million, but are only getting $8 million.  We are pursuing the point of sale (POS) model.  The committee expects this to be introduced in late September.

 

MTLS/PBX has been introduced.  It requires upgrades to existing or purchase of new systems to have ANI/ALI capabilities.  It will be required on legacy systems after 5 years.  It’s based on the Centrex model.

 

The committee is also working on the Act 78 rewrite.  The committee is as follows:  Potter County (6th class county), Kevin Fanning (representing a 5th class county), Frank Matis (representing a 4th class county), Allegheny County (representing a 2nd class county), Dave Cohick and the City of Philadelphia.  So far, we have hired an accounting firm to get the “true cost of 9-1-1.”  Our goal is to fund 9-1-1, 100%.

Presidents Report

 

Tracfone Issue

Mike Weaver reported that on August 17th, 2009, PA NENA and then Secretary Tim Baldwin were served and named in a lawsuit filed in Florida by Tracfone.  In response to a request for background information, Mike Weaver responded that PA NENA was asked to file comments with the FCC by PEMA.  The Executive Board agreed to the action.  As chapter secretary, Tim Baldwin took on the assignment in working with the Commonwealth’s Attorney General’s Office of Consumer Advocate (OCA).  Tim Baldwin signed that document on behalf of the chapter and in conjunction with the OCA.

 

In June, PA NENA hired an attorney.  His name is Michael Grab.  Grab, Lancaster County’s solicitor, and E&O insurance attorneys are covering legal issues.  Currently, our side has moved to change the venue to a federal court.  President Weaver indicated that he was not inclined to say much further since the matter is pending litigation.  He also stated he will remain the primary contact for all communication and actions involving the chapter in this suit.

 

Election

An election was held.  The results are as follows:

Keystone Award

Marcie Emhoff, of Clarion County, was presented with the annual Keystone award for her dedication to 9-1-1 issues.

 


New Business

 

Steve Shaver inquired whether it would be advantageous to countersue Tracfone due to slander.  President Weaver indicated the chapter’s priorities should be to focus on getting the case out of the Miami Dade 11th Circuit Court, and that a countersuit is not off the table for further conversation.

 

Scott Krater made a motion authorizing the Executive Board to take action it deems appropriate to reimburse Tim Baldwin for any legal expenses he might incur.  Second was made by Steve Shaver.  Motion carried.

 

Steve Shaver expressed support for Tim Baldwin and made a motion asking the membership to provide a vote of confidence for Tim Baldwin.  This was seconded by Dan Tancibok and carried by the body.

 

A motion to adjourn was made by Mike McGrady.  It was seconded by Brian Melcer.  The motion was carried and the meeting was adjourned.

 The meeting was called to order at 1517 hours.

 John Crabill was introduced as the Northeast representative from NENA National.  John greeted all in attendance.

First Vice President – No report

Treasurer – There is $2205.28 in the General fund.  The Money Market fund contains $38,252.45.  Steve Shaver (Dauphin County) made a motion to accept the Treasurer’s report.  The motion was seconded by Scott Krater (Schuylkill County).  The motion passed.

Secretary - No report

 

  1. REGIONAL ISSUES

  1. ELECTION

Steve Shaver (Dauphin County) nominated Daphne Miller (Berks County) for the Office of Secretary.  Cindy Dietz (York County) seconded the motion.  In accordance with the By-Laws, this action caused the mail-in ballots to be set-aside so a run-off election could occur.  The results of the election -

 

Frank Jannetti (Mercer County) - 29 votes

Daphne Miller - 27 votes

 

Dan Tancibok (Centre County) congratulated Frank upon winning the election.

  1. GOOD OF THE CHAPTER

David Cohick (Tioga County), Director of Tioga County DES, was awarded the Keystone Award.

Call to order by President Dietz @ 1509 Hours. President Dietz thanked Mike McGrady, Connie Turner and Dan Tancibok for their work with the 2007 conference.

 

Minutes of September 14,2006 Annual Meeting were approved as read.

Reports of Committees

 

Legislative

 

Info on the upcoming re-write of Act56 along with other legislative information will be on the PA NENA website.

 

PBX/VOIP legislation is a priority in 2007/2008.

 

There are currently a total of 10 bills to look at.

 

There is now a joint APCO/NENA legislative committee. Each member will be assigned a bill to review. The committee will prioritize the bills, do a white paper on them and meet with the Veterans Affairs/Emergency Management House Committee.

 

Conference

 

The conference dates for the 2008 State conference are September 10,11,12 2008 at the Toftrees Resort in State College.

 

There are 31 vendors.

 

235 people are in attendance.

 

Jason Barbor, NENA National President, will be the Keynote speaker.

 

Mike asked for help with the 2008 conference.

 

PUC Task Force

 

Dan Tancibok reported that the group met on September 12 2007. They reviewed legislation.

 

Bill Kiger from PA One Call is now on the national N-1-1 committee

 

The PUC is concerned that PSAP’[s aren’t reporting gas emergencies to the utilities and PIERS.

 

Next meeting is on December 13, 2007 at the Revere Tavern in Lancaster County (annual APCO banquet)

 

 

Keystone NENA Award

 

Dan Tancibok presented the 2007 Keystone NENA award to Carlton (Skip) Walls from Lancaster County.

 


New Business

 

Cindy Dietz reported on the upcoming joint APCO/NENA meeting with PEMA Director French.

 

L. Robert Kimball has started an ENP study group.

 

PA APCO annual conference is May 18-23 2008 in Lancaster

− Thanked all for coming.

            − 2007 Conference is 3rd week of September.

 

Legislative – Michael McGrady


           
− Need to contact legislators to support HB2333.

Mike will provide a sample letter if requested.

Have your Commissioners contact legislators.

Check online to see how your legislator voted.

            − Sunset of Act 56

Can’t start too early, but we need to begin planning.  Probably in 2007.

Need to work with and get support of CCAP.

Some discussion of rate structure and should all surcharges be standardized.  Preliminary discussions only.

 

PUC/911 Task Force – Tim Baldwin


           
− PUC is reviewing rules for outage.  Will be working with PTA to work out a test of the notification process without setting a minimum number of effected residences for a    six-month period to see how the process works.

            − Tim reported on his joint meeting with PUC and Office of Consumer Advocate. Primarily an information meeting to bring to the Commission some of our issues.

John Crabill, National NENA Regional VP, thanked all for an excellent conference and reminded everyone to constantly contact their legislators regarding funding legislation.

Steve Shaver (Dauphin) asked to know which counties were owed money from last year.  He has been advised by PEMA that his county and others are being audited on funds not yet received.
